CleanMochi license agreement

In short. CleanMochi is free for personal or professional use. It suggests files to delete, but you make the call. Most deletions go through the Trash and can be undone from the Log. Temporary files, app logs and emptying the Trash are permanent. This summary doesn't replace the agreement below.
1. Purpose and acceptance
This agreement is between you and NORY LLC, a Wyoming limited liability company, 30 N Gould St Ste R, Sheridan, WY 82801, United States ("we" or "us"). It covers your use of the CleanMochi app for Mac, its updates and its documentation (the "app"). By installing or using the app, you accept this agreement. If you don't, don't install the app, or delete it.
2. What you may do
We grant you a free, personal, non-exclusive, non-transferable license to install and use the app on Macs you own or control, for personal or professional use.
3. What you may not do
- sell, rent or lend the app, or distribute it for a fee;
- distribute a modified version of the app;
- decompile, disassemble or try to derive the app's source code, except to the extent the law expressly allows it, for example for interoperability;
- get around the app's technical protections;
- use the CleanMochi name, the Mochi mascot or the logo in a way that suggests a connection with us.
4. Ownership
The app is licensed, not sold. We keep ownership of the app, its code, its name, its mascot and its logo. All rights not granted to you in this agreement are reserved.
5. File deletion
The app scans your Mac and suggests items to clean up or delete. It deletes nothing until you confirm. Before you confirm, check what's selected: the decision is yours.
What goes to the Trash
Uninstalled apps and their files, leftovers from apps you already removed, installers, duplicates, large files, archives and old downloads are moved to the macOS Trash. The app's Log lets you put them back as long as the Trash hasn't been emptied and you haven't moved them.
What is deleted permanently
- temporary files and app logs, which apps recreate on their own;
- the contents of the Trash, when you choose to empty it from the app.
These deletions can't be undone from the app.
Backups
We recommend backing up your Mac regularly, for example with Time Machine, before any major cleanup.
6. Warranty
The app is provided free of charge and "as is". To the fullest extent permitted by law, we make no warranties, express or implied, including of merchantability, fitness for a particular purpose, freedom from errors, or improved performance of your Mac. This does not limit any warranty that the law of your country gives you and that cannot be waived.
7. Limitation of liability
To the fullest extent permitted by law, we are not liable for:
- the loss of files or data whose deletion you confirmed, especially the permanently deleted items described in section 5;
- indirect or consequential damages, such as lost revenue, business or time;
- effects of the app on third-party software that malfunctions or depends on temporary files.
If we are nonetheless found liable, our total liability is limited to 50 U.S. dollars, since the app is free.
These limits don't apply to intentional misconduct or gross negligence on our part, to personal injury, or where the law of your country of residence doesn't allow liability to be limited or excluded.
8. Changes and updates
We may change the app, add, modify or remove features, and release updates. This agreement also applies to updates unless they come with different terms. If a paid offer is ever introduced, it will have separate terms that you're free to accept or not.
We may change this agreement. The current version is posted on this page with its date; if a change is significant, we'll let you know in the app.
9. Termination
You can end this agreement at any time by deleting the app. If you breach this agreement, your license ends automatically and you must delete the app. Sections 4, 6, 7 and 10 survive termination.
10. Governing law and disputes
This agreement is governed by the laws of the State of Wyoming, United States. If you are a consumer, you keep the benefit of the mandatory provisions of the law of your country of residence and may bring a claim before the courts where you live. Before taking any action, please write to us: we'd rather sort things out amicably.
If any provision of this agreement is found unenforceable, the rest remains in effect.
